These Terms of Service (“Terms”) govern your use of cheerova.com and any purchase you make from Cheerova LLC (“Cheerova,” “we,” “us,” or “our”). By using this site or placing an order, you agree to these Terms. Please read them carefully.

Who may use this store

You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order. By ordering, you confirm that the information you provide is accurate and that you are authorized to use the payment method supplied.

Products, descriptions, and pricing

We work to describe our products accurately, including sizing, included pieces, colors, materials, warnings, and intended use. Colors may appear differently depending on your screen. Minor differences may occur because of lighting, manufacturing changes, supplier updates, or product batches. We do not warrant that product descriptions or other content are error-free.

Prices are shown in U.S. dollars and may change without notice. If an item is listed at an incorrect price or with incorrect information due to an error, we reserve the right to cancel or refuse any order placed at that price, whether or not the order has been confirmed and your payment method charged. If we cancel, we will refund you in full.

Orders

Your order is an offer to purchase. We may accept or decline any order, and may limit quantities per person, per household, or per order. We may refuse or cancel orders that appear to be placed by resellers, that we suspect are fraudulent, that violate these Terms, or that we are unable to fulfill.

Availability

Inventory is seasonal and limited. Availability shown on the site is our best estimate. If an item becomes unavailable after you order, we will contact you and refund that portion of your order.

Coupons, promotions, and discounts

Coupons, promotions, free-shipping offers, and discounts may be changed, limited, or ended at any time unless otherwise stated. Offers may not be combined unless clearly allowed. We may cancel or adjust an order if a promotion, coupon, or discount is used incorrectly, abusively, fraudulently, or because of a technical error.

Shipping and risk of loss

Delivery estimates are estimates, not guarantees. Title and risk of loss pass to you when the carrier takes possession of your package. Please see our Shipping Policy for details.

Returns

Returns and refunds are governed by our Returns & Refunds policy, which forms part of these Terms.

Product safety

Costumes, decorations, accessories, and related products are seasonal novelty items. Costumes and accessories are not protective equipment. Please review product labels, warnings, sizing, age guidance, use instructions, and our Legal Notice & Product Safety policy before use.

You are responsible for using products safely and appropriately, including keeping items away from flames, heat sources, water, small children, pets, and unsafe conditions when applicable.

Intellectual property

The Cheerova name, logo, site design, product photography, graphics, written content, and other website materials are owned by Cheerova LLC or used with permission and are protected by intellectual property laws. You may not copy, reproduce, distribute, modify, display, or use them commercially without written permission from Cheerova LLC.

Any third-party names, brands, characters, trademarks, movie titles, show titles, game titles, or references belong to their respective owners. Unless clearly stated, Cheerova products are not sponsored, endorsed, licensed, or affiliated with any third-party brand, movie, show, game, or character owner.

Reviews, photos, feedback, and submissions

If you submit a review, photo, comment, message, idea, suggestion, or other content to us or through our website or social media, you confirm that you have the right to submit it and that it does not violate another person’s rights.

You allow Cheerova LLC to use, display, reproduce, edit, and share that content for customer service, marketing, website, social media, and business purposes, unless prohibited by law. We may remove or decline to publish submissions that we believe are inappropriate, misleading, unlawful, offensive, or unrelated.

Acceptable use

You agree not to use this site to break any law, infringe intellectual property rights, submit false or misleading information, interfere with site operation or security, scrape or harvest data, abuse promotions, attempt unauthorized access, or misuse our products, services, or content.

Limitation of liability

Where liability cannot be excluded, it is limited to the amount you paid for the product concerned.

Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any dispute will be brought in the state or federal courts located in Fairfax County, Virginia, and you consent to the jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. The version in effect at the time you place an order governs that order. We will update the date at the top of this page when changes are made.
